Bill to Create Stand-Alone Misclassification Violation

    Bill: S 8210

    Creates definition of independent contractor for purposes of wage payment law, in essence creating stand-alone violation for misclassification of employees. Creates a violation of the NY labor law where an individual is not paid the legally required wages or from whose wages state taxes are not withheld, a private right of action, and authorizes mechanism for private attorneys general actions in cases of violation.
