Fair Playing Field Act of 2012 Seeks to Repeal Section 530
The Fair Playing Field Act of 2012, S. 2145 and H.R. 4123, was introduced on March 1, 2012, by Senator John Kerry (D-Mass) and Representative Jim McDermott (D-Wash), respectively. This 2012 bill is the same as the Fair Playing Field Act of 2010, S. 3786 and H.R. 6128, which Senator Kerry and Representative McDermott introduced on September 15, 2010, with one exception.

Self-Employed Individuals Are an Important Segment of the U.S. Economy
“Self-employment continues to be an important source of jobs in the United States,” according to Steven F. Hipple, an economist with the Bureau of Labor Statistics (“BLS”). In an article he published in the September 2010 issue of the Monthly Labor Review, titled “Self-employment in the United States,” Hipple explains that BLS data indicate that in 2009 there were 15.3 million self-employed individuals. While that figure includesboth the unincorporated and incorporated self-employed, nearly two-thirds were unincorporated, according to the article. Overall, the self-employed in 2009 represented 10.9% of total employment.

Court Upholds Concession Agreement at LA Port Mandating Employee Truck Drivers
In a decision with adverse consequences to any independent contractors who provide services in connection with a government facility, a federal court upheld a Concession Agreement that the Los Angeles Harbor Board of Commissions imposed on all motor carriers that provide drayage services at its port, which permits only employee truck drivers.
